TAVOLON Test Version — Terms of Use
Version: 2026-09-13.1 | Effective for new acceptances from 13 September 2026

1. Provider and scope
TAVOLON is provided by Tavolon Intelligence Co., Limited, a Hong Kong private company limited by shares, Business Registration Number 81209972. Registered office: Flat A 15/F Goldfield Industrial Building, 144-150 Tai Lin Pai Road, Kwai Chung, Hong Kong. You may contact us through Support in the TAVOLON app or by writing to this address. “We”, “us” and “our” mean this company. These terms govern use of the TAVOLON app and its associated services. They do not replace a separate purchase contract or remove rights against the seller of your hardware or software.

2. Current test version and development
TAVOLON is currently a test/beta version under active development. Development takes place on an ongoing, potentially daily basis. The interface, supported adapters, vehicle programs, data, updates and functions may change. Some functions are incomplete, unavailable or not yet verified on particular vehicles. Errors, inaccurate or incomplete results, connection failures, interrupted operations, slow responses and crashes can occur. A listed manufacturer, installed package, successful VIN identification or detected adapter does not establish that every control unit, system scan, topology, service function, coding or programming operation is supported. Test status does not excuse failure to provide binding contractual promises or mandatory legal standards.

3. Activation and permitted use
Activation requires an eligible VCI serial number, an available device allocation and your affirmative acceptance of the displayed terms and test-version notice. A serial number is an identifier, not a password or proof of ownership. Subject to your applicable purchase and entitlement, we grant you a limited, non-exclusive right to use the app and the programs assigned to your installation. You must have permission to access the adapter and vehicle. Do not share installation credentials or use the service for unauthorized access, unlawful modifications, or circumvention of vehicle security or emissions requirements. Rights in third-party software, data, vehicle information and trademarks remain with their respective holders; these terms do not transfer those rights to us or to you.

4. Vehicle safety and verification
Use the app only when the vehicle is safely stationary and with the knowledge, equipment and authorization required for the operation. Follow the vehicle and adapter manufacturer's applicable procedures, including power-supply requirements. Independently verify diagnostic findings before making repair or safety decisions. Do not treat the app as the sole basis for deciding that a vehicle is safe or roadworthy. Do not start an actuator test, service procedure, coding or programming operation unless support for the exact vehicle and operation has been established and the applicable procedure is understood. Stop if the connection, supply voltage, vehicle identification or procedure is uncertain. Never operate the app while driving. Keep appropriate records and backups before making changes. These duties do not relieve us of liability that cannot lawfully be excluded.

5. Availability, files and updates
Programs are supplied according to your server-side entitlement and the files actually available for your adapter profile and app version. Downloads must complete and pass installation checks before use. An update notification is not confirmation that the update is installed. Some services need an internet connection; local diagnosis depends on the locally installed programs, hardware and supported communication. We do not promise uninterrupted availability, a particular response time, support for every vehicle or future feature, or that every defect will be corrected. We will respect mandatory obligations concerning updates, conformity and remedies. Material changes to these terms require fresh affirmative acceptance where required and do not operate retrospectively. Your existing statutory rights and accrued claims remain unaffected.

6. Warranty exclusions to the extent permitted by law
Except for express contractual commitments and rights that cannot lawfully be excluded, the test version is supplied “as is” and “as available”. To the maximum extent permitted by applicable law, we exclude implied warranties or conditions of accuracy, completeness, uninterrupted operation, satisfactory quality, fitness for a particular purpose and compatibility. No diagnostic result, support suggestion or update notice constitutes an additional guarantee unless expressly agreed as such. These exclusions do not remove mandatory consumer rights, legally required digital-content conformity, applicable remedies, express guarantees, or obligations that cannot lawfully be excluded or restricted.

7. Liability and mandatory exceptions
We seek to limit liability to the maximum extent permitted by applicable law. Nothing in these terms excludes or limits liability for death or personal injury caused by negligence; fraud or fraudulent misrepresentation; intentional misconduct or gross negligence; mandatory product liability; an express guarantee to the extent that it requires liability; or any other liability, remedy or consumer right that applicable law does not permit us to exclude or restrict. These exceptions take priority over every other provision of these terms.

Subject to those exceptions, liability for ordinary negligence is limited to loss that was foreseeable and typical of the contract where an essential contractual obligation is breached. An essential obligation is one whose performance enables the contract to be properly performed and on which you may normally rely. To the extent permitted by law, liability for other ordinary negligence is excluded. Where legally effective and subject to the preceding rules, we exclude liability for indirect or consequential loss, lost profit, lost business, lost opportunity, downtime and loss of data. No exclusion applies where it would defeat a mandatory remedy or an essential contractual obligation.

We are not responsible for loss to the extent actually caused by unauthorized use, use contrary to the applicable procedure, unsupported modifications, defective third-party hardware, interrupted vehicle power, or external network failures beyond our reasonable control. This does not exclude responsibility for our own legally relevant contribution to the loss. You should take reasonable steps to avoid and reduce loss, without waiving any mandatory rights. If applicable law requires a narrower limitation, only the limitation legally permitted in that situation applies; these terms do not promise that every exclusion will be enforceable in every jurisdiction.

8. Technical information and support
To activate and operate the service, TAVOLON uses the VCI serial number, a random installation credential, app and adapter versions, and installation status. The service receives an inventory of installed vehicle programs and structured technical error information to help investigate faults. Automatic diagnostic reports are limited to technical metadata; they are not a continuous upload of raw vehicle traffic. Local diagnostic logs are retained for up to 24 hours and subject to storage limits, with cleanup when the app or its cleanup work runs. Automatic technical reports on the server are retained for up to 24 hours. Support messages and your chosen screenshots or diagnostic-log attachments are associated with your serial number and installation. Server-side support attachments expire after 30 days; support conversations and acceptance records have separate retention needs and are not automatically erased after 24 hours. Do not send unrelated personal information or secrets in a support message. Contact Support for questions about your data or to exercise applicable data rights. Acceptance of these terms is not consent to advertising or to every possible future use of personal data. Applicable data-protection duties and rights remain unaffected.

9. Suspension, discontinuation and existing rights
You may stop using the app at any time. We may restrict access where reasonably necessary to address unauthorized use, a security problem or a material breach, subject to applicable notice, proportionality and remedy requirements. Development features may be changed or withdrawn subject to your contractual and mandatory rights. Merely calling the app a test version does not remove refund, repair, replacement, withdrawal or other rights that apply to your transaction. These terms do not waive claims arising before acceptance.

10. Applicable law and final provisions
Hong Kong law applies to the extent a choice of law is legally effective. If you are a consumer, this choice does not deprive you of mandatory protection under the law that would otherwise apply, including the law of your habitual residence where applicable. Mandatory rules about jurisdiction and access to your local courts remain unaffected. No exclusive foreign-court requirement is imposed on consumers by these terms. If a provision is invalid, applicable law determines its effect and the remainder continues only to the extent legally permitted. These English terms can be reviewed in the app and downloaded at https://motra.ml24shop.de/legal/tavolon-terms-2026-09-13-en.txt. The acceptance record identifies the exact text version, its checksum, your VCI serial number, installation and the server's receipt time.

Before activation, confirm both statements yourself:
“I understand that TAVOLON is currently a test/beta version, with incomplete or unverified functions and the limitations described above.”
“I have read and agree to the TAVOLON Terms of Use, version 2026-09-13.1, including the liability provisions and their mandatory legal exceptions.”

If you do not agree, select Decline. No new activation will be completed through this screen.
